These Terms of Service ("Terms") govern access to and use of Themezer, a moderated platform for fan-made console customization content. By creating an account or using Themezer, you agree to these Terms. The Community Guidelines supplement and are incorporated into these Terms, and use is also subject to the Privacy Policy.

These Terms cover account use, uploader responsibilities, moderation, copyright, restricted adult content, privacy, and other rules needed to keep Themezer safe, lawful, and reliable for users and partners. Copyright reporting procedures are available on the Copyright / DMCA page.

Uploader Responsibility

You are responsible for content you upload, publish, or link through Themezer. By submitting content, you represent that you have the right to share it, that it complies with applicable law, that you have the rights needed to grant the service license below, and that it follows these Terms and Themezer's posted policies.

Ownership and Service License

Uploaders retain the rights they own in their submissions. By uploading content, you grant Themezer a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute that content solely to operate, secure, and promote the service.

Fan-Made Content and Third-Party Rights

Themezer hosts fan-made, user-submitted content and is not affiliated with Nintendo or other rights holders. Uploaders are responsible for ensuring that submissions do not violate third-party rights. Themezer may remove or restrict content in response to valid rights-holder requests or when content creates legal or platform risk.

Copyright and Rights-Holder Requests

If you believe content on Themezer infringes your copyright or other rights, contact [email protected] or use the DMCA Request Form. Formal rights-holder requests should include enough detail for Themezer to review the request, including the copyrighted work, the exact location of the material on Themezer, and your authority to act.

Moderation and Enforcement

Themezer may review, unlist, relabel, restrict, or remove content and may suspend or terminate accounts when content or conduct violates these Terms, creates safety risk, creates advertiser or platform risk, or exposes Themezer or its users to legal harm.

Prohibited Conduct and Content

Restricted Adult Content

Themezer may make restricted adult content available only to logged-in users who explicitly enable adult-content access and only where legally permitted. Adult-content upload and labeling standards are part of the Community Guidelines, and Themezer may relabel, restrict, unlist, or remove restricted adult content that violates those standards or creates legal, safety, or platform risk.

Abuse, Security, and Reporting

Any attempt to exploit, spam, or cause harm through Themezer may result in immediate enforcement action. Users can report site issues, abuse, or policy concerns through Themezer's reporting tools or by contacting [email protected].

Disclaimer and Limitation of Liability

Themezer is provided "as is" without warranties of any kind. Themezer is not liable for any loss, damage, or data corruption resulting from the use of the service. Users assume full responsibility for their content and actions on the platform.

Themezer may contain links to third-party websites or integrations. Themezer is not responsible for the content, security, or privacy practices of those external sites. Access them at your own risk.

Modification of Terms

Themezer may update these Terms, the Community Guidelines, and related policies at any time. Continued use after changes take effect constitutes acceptance of the updated rules. Governing Law

These Terms are governed by and construed under the laws of the jurisdiction where Themezer operates. Any disputes arising from or relating to the service will be handled in that jurisdiction's competent courts.

Account Termination
